Integrating integrity in procurement: a review of the implementation of public procurement act in Nigeria

Abstract

Public procurement refers to the process by which public authorities, such as government departments, local authorities or any public organisation, purchase work, goods or services from companies or private sectors which they have selected for their purpose via a due process and procedures laid out in any procurement legislation. This paper examines the legal framework for the Public Procurement Act (PPA) in Nigeria, the objective, coverage, and effectiveness of the Act. It also identifies the problems affecting full implementation of the Act and possible redress/remedies to these problems. The paper further looked at the key areas within the Act perhaps that need further reviews to strengthen the laws surrounding the applicability of the Act in Nigeria. It also looks at public procurement in other jurisdictions and adopts best practices from EU Public Procurement Acts in integrating integrity in public procurement in Nigeria. The paper concludes that full implementation of the Act remains an elusive objective despite measures already taken. It recommends amendment to the Act with the view of adopting best practices based on procurement rules and procedures.
